Former club member and past president Scott Malm presented a program entitled, “Real Estate Issues Every Home Owner Should Know About.”
Scott is an attorney with Gust Rosenfeld, one of the oldest law firms in Arizona and a long-time sponsor of our Hole-in-One Contest. Scott noted he was a Rotary Ambassadorial Scholar to Wales. He also said his daughter, Lauren, who is a junior in high school, has been accepted to do summer school work at Yale.
Scott had a Power Point presentation he titled, “Lost in Translation.” Included were several points of law regarding home owner situations. He discussed many of them and cited cases which showed some of the problems which might arise.
He said most of his work is done with title insurance companies and that his clients don’t pay him; the title insurance companies do. He noted that a person can not sue a title insurance company for negligence, but only if there is a breach of contract by the title insurance company. Liability also may be taken into consideration.
